As a sole trader, the owner is personally and without limit liable for the obligations arising from the business.
These terms govern use of https://imporwell.com and the engagement of our services.
2.Nature of the business
We provide vehicle sourcing, importing and registration services. We are not an official representative of any car brand; makes and models are named only to identify vehicles and remain the property of their manufacturers.
We are neither a credit institution nor a registered credit intermediary. Any financing is contracted directly between you and the relevant institution.
3.Listings, prices and availability
Cars shown may be located outside Portugal and availability is confirmed at the time of enquiry.
- The advertised price is the turn-key price in Portugal and includes: the car, inspection at origin, insured transport, vehicle tax, type B inspection, registration and our fee.
- It excludes: car insurance, the following year's road tax, additional maintenance you request, and delivery outside mainland Portugal.
- Monthly figures shown are simulations on fixed assumptions, are not a credit offer and bind no institution.
- Obvious pricing or description errors do not bind Imporwell and are communicated as soon as detected; either party may then withdraw without cost.
4.Formation of the contract
Engagement is confirmed in writing, identifying the vehicle, the final price, estimated timelines and payment terms. No amount is due before that point.
Where a deposit applies, its amount, purpose and refund conditions are set out in the contract.
5.Timelines
Timelines given are good-faith estimates, typically four to six weeks from approving a car to delivery with Portuguese plates. Delays caused by third parties such as transporters or public authorities are communicated as soon as known.
6.Right of withdrawal
For distance contracts with consumers you have a 14-day right of withdrawal under Portuguese Decree-Law 24/2014, without needing to give a reason.
The law provides exceptions, notably where the service has been fully performed with your prior express agreement, or where the goods were sourced to specifications you supplied and are clearly personalised. Since sourcing a specific car often falls into the latter case, the contract states expressly, before any payment, whether and to what extent the right of withdrawal applies to your case.
7.Warranty
The statutory conformity warranty under Decree-Law 84/2021 applies. For used movable goods sold to consumers the period is three years, which the parties may reduce in writing to no less than eighteen months; any such reduction is stated expressly in the contract.
Cars still covered by the manufacturer's warranty retain it on the manufacturer's terms, valid across the European Union.
8.Your obligations
- Provide true and complete information and documents for the registration process.
- Make agreed payments within the agreed periods.
- Tell us promptly of any change of address or contact details relevant to delivery.
9.Liability
We are liable for damage resulting from culpable breach of our obligations. We are not liable for matters attributable to you, to third parties outside the contract, or to force majeure, nor for indirect loss of profit. Nothing here limits liability that the law does not allow to be limited, in particular for intent or gross negligence and in matters of consumer rights.
10.Content submitted by clients
By submitting a testimonial you authorise us to publish it on the site under the name you give. We publish only after review, and may refuse or remove content that is false, offensive, identifies third parties without permission, or does not relate to a service actually provided. You may request removal at any time.
11.Intellectual property
The content of this site, including text, images and the Imporwell name, belongs to the company or is used with permission, and may not be reproduced without written consent.
12.Complaints and dispute resolution
You may complain through our contact channels or the electronic complaints book at livroreclamacoes.pt.
In a consumer dispute you may refer the matter to an alternative dispute resolution body under Portuguese Law 144/2015; the list is available at www.consumidor.gov.pt. You may also use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
13.Governing law
Portuguese law applies. Without prejudice to mandatory consumer protection rules, which allow you to bring proceedings where you live, the courts of the company's registered seat have jurisdiction.
